Terms and Conditions

These Terms and Conditions govern the use of the promoracing.enigma-tech.it website and the purchase of products, gift cards and services/experiences (e.g. free practice sessions, events, Corporate) offered by Promo Racing Srl.

2. Object
The Site allows you to:
Purchase products (e.g. tires and accessories);
Purchase virtual gift cards;
Book and purchase experiences/events (motorcycle free practice, car free practice, MotoGP Live, Corporate and similar).
3. Acceptance of the conditions
By placing an order on the Site, the User declares that he has read, understood and fully accepted these Terms and Conditions, as well as the Privacy Policy and the Cookie Policy.
4. Prices and payment
Product and service prices are indicated in euros and include VAT, unless otherwise indicated. Payment is made by credit/debit card via a secure payment gateway; card details are not stored by the Site. Promo Racing reserves the right to change prices at any time, without prejudice to the prices confirmed for orders already placed.
5. Gift Card
Gift cards purchased on the Site have a prepaid face value, can be used as credit at checkout, and bear the name of the beneficiary specified by the purchaser. Gift cards are not refundable for cash, unless otherwise required by law, and may have a validity period specified at the time of purchase.
6. Booking events and experiences
Event bookings (e.g., free practice on track, MotoGP Live, corporate experiences) are subject to availability and the specific conditions listed on the individual event page (date, time, any requirements such as a medical certificate, optional extras). Bookings are confirmed upon payment.
7. Right of withdrawal
For purchases of physical products, the consumer User has the right to withdraw from the contract within 14 days of receiving the goods, pursuant to Articles 52 et seq. of the Consumer Code (Legislative Decree 206/2005), without having to provide a reason.
The right of withdrawal does not apply, pursuant to art. 59 of the Consumer Code, among others:
to provide services relating to events and bookings for a specific date (e.g. track tests, corporate experiences);
to the provision of gift cards and shopping vouchers, once issued;
to goods made to measure or clearly personalized.
To exercise the right of withdrawal, where applicable, the User must send written notice to info@promoracing.it within the established deadlines.
8. Shipping and delivery
Purchased physical products are shipped via courier to the addresses indicated during checkout. Estimated delivery times are communicated during the purchase process and may vary based on product availability.
9. Legal guarantee of conformity
The 24-month legal guarantee of conformity provided for by Articles 128 et seq. of the Consumer Code applies to purchased products.
10. Responsibility
Promo Racing Srl is not responsible for any technical malfunctions on the Site not attributable to its fault, nor for damages resulting from improper use of purchased products or participation in track events, subject to compliance with the safety regulations communicated during the booking phase.
11. Intellectual property
All content on the Site (texts, images, logos, trademarks) is the property of Promo Racing Srl or licensed to it, and may not be reproduced without permission.
12. Applicable law and competent court
These terms and conditions are governed by Italian law. For disputes with consumer Users, the court of the consumer's place of residence or domicile, if located in Italy, has jurisdiction. The option of resorting to the European Online Dispute Resolution (ODR) platform remains valid: http://ec.europa.eu/consumers/odr/.
13. Changes to the Terms
Promo Racing Srl reserves the right to modify these Terms and Conditions at any time; any changes will be posted on the Site, indicating the date of the last update.
