This Notice, provided pursuant to Article 13 of EU Regulation 2016/679 (GDPR), describes how Promo Racing Srl processes the personal data of users who visit the promoracing.enigma-tech.it website, purchase products or services, or book events through the Site, and how users can exercise their rights.

1. Data collected

Contact information: name, surname, email address, telephone number, and message, provided voluntarily by the User via the Site's contact form.
Account and order data: billing and shipping address, products purchased, gift cards issued and used, event/experience reservations, provided during registration, purchase, or reservation.
Payment data: managed directly by the credit card payment service provider; the Site does not store card data.
Browsing data: IP address, browser type, pages visited, date and time of visits, and other technical data relating to use of the Site.

Collection method:

Directly from Users, via contact form, account creation, checkout, or event booking.
Automatically, via technical logs and cookies (see Cookie Policy).

2. Purpose and legal basis of the processing

a) Response to contact requests
Legal basis: execution of pre-contractual measures at the request of the data subject (Article 6.1.b GDPR).

b) Management of orders, purchases, gift cards and event reservations
Legal basis: performance of the contract (Article 6.1.b GDPR).

c) Administrative, fiscal and accounting obligations
Legal basis: legal obligation (Article 6.1.c GDPR).

d) Security and correct functioning of the Site
Legal basis: legitimate interest of the Data Controller (Article 6.1.f GDPR).

e) Site usage statistics through analytical cookies
Legal basis: consent (Article 6(1)(a) GDPR), revocable at any time.

Providing data for purposes a), b), and c) is mandatory; without it, we will not be able to respond to your request or process your order or reservation. Providing data for purpose e) is optional, and refusal will not affect your browsing or purchase experience.

3. Data recipients and transfers outside the EU

The data may be communicated to:

Service providers acting as data processors (Article 28 GDPR), including: hosting service (Hostinger), credit card payment service providers, couriers and shipping services.
Professionals and consultants (e.g. accountants) for legal compliance.
Competent authorities, when required by law.

The data is not sold or transferred to third parties for their marketing purposes.

Some providers may process data outside the European Economic Area, particularly in the United States. In this case, the transfer is based on the EU-US Data Privacy Framework or the Standard Contractual Clauses approved by the European Commission (Articles 45-46 GDPR).

Contact requests not followed by a purchase: 24 months from the last contact.
Data relating to accounts, orders, gift cards, and reservations: for the duration of the commercial relationship and subsequently for 10 years (Article 2220 of the Italian Civil Code) for administrative and tax purposes.
Technical logs: for the period provided by the hosting provider.
Cookies: according to the durations indicated in the Cookie Policy.

7. User Rights

Pursuant to Articles 15-22 of the GDPR, the User may at any time:

Access your data.
Request its correction or deletion.
